In the matter of the application of Lilian Wheal, 28 widow of Isaac Alfred Wheal, for a pension under the Widows' and Orphans' Pension Ordinance, 1908, Urdinance No.15 of 1908, (Hong Kong) .
Opinion of the Crown Solicitor (Hong Kong).
The facts before me are,

Isaac Alfred Wheal, a public officer within the Pension Minute, Hong Kong, was invalided from the
service.
Un his retirement he was granted a pension commencing on 5th August, 1914.
Un such retirement he was married, but had no
children pensionable; his wife was Annie Bertha Wheal,
Annie Bertha Wheal died on 22nd April, 1915. Isaac Alfred Wheal contributed to the widows)
and Orphans' Pension Fund (Hong Kong); he was a
contributor to such fund at the death of Annie Bertha
Wheal.
On the death of Annie Bertha Wheal the said
Isaac Alfred Wheal expressed a wish to continue to contribute to the said Widows' and Orphans' Fund "in case he should marry again".
The question whether he should continue to contribute was referred by the Crown Agents for the Colonies to the Hong Kong Government.
The answer of the Hong Kong Goverment was "that Mr. Wheal's interest in the Widows' and Orphans'
Pensions Fund ceases on the death of his wife and
that his contributions should be discontinued from
that date".
